CHRISTINA'S STORY:

I was never apart of the robbery, which would not make me responsible under the law of parties. I did not take part of the crime, nor was I aware of the robbery or the murder that took place.

CHRISTINA'S CASE REPORTS:
    * BRIEF FACTUAL SUMMARY:
    I am currently incarcerated in TDCJ, serving a Life Sentence for Capital Murder, under the law of parties. I was convicted along with five other people, all of which life sentences were imposed, except for the one who was the State's witness, who received 20 years. I was charged because they said I should have anticipated that a murder would occur because I was with known gang members. I was convicted in large part because of the accomplice witness's testimony. I won my first appeal and it was reversed and remanded to a new trial. The Court ruled that the gang evidence was prejudicial. The higher Court ruled against the lower Court's decision, because they said my lawyer didn't preserve the error by objecting to the evidence.

    * LIST OF EVIDENCE USED AGAINST THE DEFENDANT:
    1] Accomplice testimony
    2] My video tape statement on July 2, 1999 that places me near the scene, but being present cannot solely convict you.
    3] Grand Jury testimony

    * SUMMARY OF THE EVIDENCE SUPPORTING CLAIM OF INNOCENCEL:
    I have the testimony of the main actor [Hersain Gomez] in this case stating in court that only him, the state's witness [Crystal Garcia], and another co-defendant [Susana Arroyo] were involved. Also, I have an affidavit from another co-defendant [Michael Thompson] stating that he lied in his initial statements against me, because he was coerced into saying things. He said he would testifed in my behalf, which would have contradicted testimony given by the state's witness in the lower court's opinion in 147 S.W.3d 410 [2001], it states "although Appellant has not raised the issue of legal sufficiency, there is little other evidence, if any, which could arguably be construed to independently support the so-called knowledge element." The jury has to find you guilty of all elements of the penal code in order to secure a conviction. They must show that I was a part of the conspiracy to commit robbery, to be responsible for murder, also. The testimony of the main actor Gomez would prove that I was never involved in the conspiracy to commit robbery. Also, there was a detective that testified in my other co-defendant's trial, that I was not in any of their gang books as a member or an assoicate. The state's witness was given 20 years, even though she was one of the main actor's in the actual killing. It has never been disputed that I ever took part in the actual murder. I have also found out recently that she had a bigger role in the crime than I was originally aware of. I hope that this could be proven by some sort of forensic testing of some sort. She also has since been questioned about her role in another murder, which I would think would definitely cause some doubt on the credibility of her testimony. Her testimony has been different in every trial.
